This disclaimer ("Disclaimer", "Agreement") is an agreement between ‘M/s NEXTGEN MULTITOUCH PRIVATE LIMITED’ (“Nextgen” / “Developer” / "Mobile Application Developer", "us", "we" or "our") and you, viz., the intending participant (hereinafter referred to as "User" / "you" or "your"). This Disclaimer sets forth the general guidelines, terms and conditions of your use of the ‘VOTE IS RIGHT’ online mobile gaming application and any of its products or services (collectively, "Online Gaming Mobile Application" or "Services").

Any views or opinions represented in this application, VOTE IS RIGHT, belong solely to the content creators and do not represent those of people, institutions or organizations that M/s NEXTGEN MULTITOUCH PRIVATE LTD. or creators may or may not be associated with in professional or personal capacity, unless explicitly stated. Any views or opinions are not intended to malign any political party/candidate or their followers, religion, ethnic group, club, organization, company, entity, person or any individual. In this aspect, all details pertaining to the candidates of political capacity have been taken and accumulated from the official website of Election Commission of India in consonance with their copyright and privacy policies.

Further, M/s NEXTGEN MULTITOUCH PRIVATE LIMITED explicitly intends that the online gaming mobile application ‘VOTE IS RIGHT’ does not promote or intend to promote any activities of betting or wagering or any act which is intended to aid, induce, solicit or facilitate wagering or betting or such collection, soliciting, receipt or distribution of prizes or money that the game winners shall so receive.

The User may submit content in the form of their game selections on VOTE IS RIGHT. By playing the game according to the said guidelines or otherwise making available any information to M/s NEXTGEN MULTITOUCH PRIVATE LTD., they grant the developers the unlimited, perpetual right to distribute, display, publish, reproduce, reuse and copy the information contained therein. User may not impersonate any other person through the VOTE IS RIGHT mobile application. User may not post content that is defamatory, fraudulent, obscene, threatening, invasive of another person's privacy rights or that is otherwise unlawful. No one can post content that infringes on the intellectual property rights of any other person or entity. User may not post any content that includes any computer virus or other code designed to disrupt, damage, or limit the functioning of any computer software or hardware. By submitting or posting content in VOTE IS RIGHT, you grant M/s NEXTGEN MULTITOUCH PRIVATE LTD. the right to edit and, if necessary, remove any Content at any time and for any reason.

Some of the links in the VOTE IS RIGHT application may be "affiliate links" directing to our sponsors. Further aspects of gaming sponsorship are to be put forth. The online gaming application relies on external sponsorships for means of final winning prize/gift/winner title being allotted to the candidates with respect to the game selections accordingly. The said prize money attributed to each category of correct selections is accordingly distinguished by way of different kind of prize sponsorships offered by our sponsorship affiliates. The benefits/prizes offered under the present VOTE IS RIGHT gaming application is confined to participants from India only and nothing in VOTE IS RIGHT application, so promoted will confer any rights, interest or claim of any sort to non-resident Indians, foreign nationals or any person, whomsoever, including an Indian by origin or by citizenship, accessing the mobile application from other part/s of the world and not from a place in India1 . It is to be noted that, any Foreign User or Foreign resident (including NRI) choosing to participate, use or in playing or indulging in the VOTE IS RIGHT mobile application is not entitled to receive any prizes or prize money beyond the territorial borders of India and the Developers have no such mechanism or facility for shipping the gifts or crediting the prize money to such foreign Users.

The said online gaming application has restricted User information strictly to their respective name and mobile number. In this aspect, all communication between the User and the application shall be confined to SMS/Notification mode only. In circumstances leading to any delay or action withholding general election results of one or more constituencies, the winners shall be ascertained from the selections given for the remaining declared constituencies, on prorate basis upon reducing such constituencies in respect of which results are not declared within 31st of May, 2019, for whatsoever reasons. Furthermore, the respective winners so announced and displayed in the Results section of the VOTE IS RIGHT Mobile App shall be given a period of 7 days from declaration of game winners to claim their title/gift/cash prizes. Subject to the rules aforementioned, every User shall be contacted offline for further procedures to claim such prize money. The Developer/Nextgen’s responsibility on distribution of Prize money is limited to the extent of acting as an agent in between the User and the Sponsor to facilitate the distribution of the Prize money/gift articles, if any, and the sole responsibility on dispersing the same lies on the Sponsors only.

M/s Nextgen Multitouch Private Limited guarantees the accuracy, reliability and completeness of the information and content on, distributed through or linked, downloaded or accessed from Vote is Right’s mobile application. Furthermore, information contained in the aforementioned application and any pages linked to and from it are subject to change at any time and without warning. We reserve the right to modify this Disclaimer relating to VOTE IS RIGHT or services at any time, effective upon posting of an updated version of this Disclaimer in the application. When we do, we will revise the updated date at the bottom of this page. Continued use of VOTE IS RIGHT after any such changes shall constitute your consent to such changes.

The User should acknowledge that you have read this Disclaimer and agree to all its terms and conditions. By accessing the VOTE IS RIGHT online gaming application, user is agreeing to be bound by this Disclaimer. If you do not agree to abide by the terms of this Disclaimer, you are not authorized to use or access the VOTE IS RIGHT online gaming mobile application.
